These Terms of Service (“Terms”) are a binding agreement between you and AFC (“Ambition. Foundation. Creation.,” “AFC,” “we,” “us,” or “our”) governing your use of afsoccer.club (the “Site”) and the training programs, bookings, accounts, and related services we provide (together, the “Services”). Please read them carefully. By creating an account, booking a session, making a payment, or otherwise using the Services, you agree to these Terms, our Privacy Policy, and our Athletic Waiver. If you do not agree, do not use the Services.
1. Who may use the Services
- You must be at least 18 years old and able to form a binding contract to create an account, book a session, or make a payment.
- Every booking for a minor athlete must be made by the athlete’s parent or legal guardian, who is responsible for the athlete’s participation and for these Terms.
- By booking for an athlete, you confirm that you are that athlete’s parent or legal guardian and have authority to agree to these Terms on their behalf.
2. Your account
- You agree to provide accurate, current information and to keep it up to date.
- You are responsible for keeping your password and account secure and for all activity under your account. Tell us promptly if you suspect any unauthorized use.
- Please do not maintain duplicate accounts. We may suspend or close accounts that violate these Terms or that are used for fraud or abuse.
3. The programs we offer
- AFC offers private and small-group youth soccer and multi-sport training, including Foundations, Performance, Elite, and seasonal camps. Program details, age ranges, formats, and locations are described on the Site and may change.
- Elite enrollment begins with an application and a paid Assessment Pathway before any ongoing membership. Completing the Assessment Pathway does not guarantee acceptance into Elite membership.
- Sessions take place at the fields and parks listed on the Site. Locations can change due to availability, weather, or facility access.
4. Booking, scheduling, and tokens
- Sessions are booked through the Site and are subject to availability and coach capacity.
- Prepaid value on your account is held as AFC Tokens: 1 Token = $1. Tokens never expire and can be spent on any program or format. A limited number of one-time drop-ins may be available.
- We may occasionally need to reschedule a session or substitute a coach. We will give you as much notice as we reasonably can.
5. Pricing
- Prices are shown on the Site per program or package, in U.S. dollars. We may change prices at any time, but a change does not affect sessions or packages you have already paid for.
- Posted prices may not include applicable taxes or fees, which will be added where required.
- We work to keep pricing accurate. If a price is listed in obvious error, we may cancel the affected order and refund any amount charged.
6. Payments and billing
- Payments are processed securely by our third-party payment processor, Stripe. By providing a payment method, you authorize us, through Stripe, to charge the full amount of your booking or package plus any applicable taxes.
- We do not collect or store your full card number. Card data is handled by Stripe under its own terms and privacy policy; we keep only a record of the transaction.
- You represent that you are authorized to use the payment method you provide.
- If a charge fails, is reversed, or is charged back, we may suspend the related booking or account and pursue amounts you owe. Please keep your billing information current.
- Receipts are emailed to you and are available in your account.
7. Cancellations, rescheduling, refunds, and no-shows
- Notice. Please give at least 24 hours’ notice to cancel or reschedule a session.
- Late cancellations and no-shows. A session cancelled with less than 24 hours’ notice, or a no-show, may forfeit that session or its tokens.
- Cancellations by AFC. If we cancel a session, for example due to weather or coach availability, we will return your tokens or reschedule it.
- Refunds. Refund requests are reviewed case by case. Token loads are generally non-refundable once training has begun; tokens from a session we cancel are returned to your wallet. Where a cash refund is issued, it is returned to the original payment method through Stripe.
- Nothing in this section limits any rights you may have under applicable law that cannot be waived.
8. Waiver, assumption of risk, and health
- Athletic training involves inherent risks, including physical contact, falls, and injury. Participation is governed by our Athletic Participation Agreement and Release of Liability, which you sign during booking.
- You confirm that the athlete is in good health and able to participate, and you authorize emergency medical care if you cannot be reached, as set out in the Waiver.
9. Code of conduct
- Athletes, parents, and guests are expected to treat coaches, staff, and other participants with respect and to follow coach and facility rules.
- We may refuse, suspend, or end participation, without refund, for behavior that threatens safety, disrupts training, or violates these Terms.
10. Media and likeness
With the consent you provide in the Waiver, we may capture and use photos and video from sessions for coaching and promotion. You may withdraw media consent as described in the Waiver and our Privacy Policy.
11. Communications consent
By creating an account or booking, you agree to receive service messages (confirmations, receipts, reminders, schedule changes, and account notices) by email and, where you provide a number and consent, by text. These messages are part of the Services. Marketing messages are opt-in, and you can unsubscribe at any time. See our Privacy Policy for details.
12. Intellectual property
- The Site and its content, including text, graphics, logos, photos, video, training curricula, and software, are owned by AFC or its licensors and protected by intellectual property laws. “AFC,” “Ambition. Foundation. Creation.,” and related marks are our trademarks.
- We grant you a limited, personal, non-exclusive, non-transferable license to use the Site to book and manage your training. You may not copy, resell, scrape, reverse engineer, or create derivative works from the Site or our curricula without our written permission.
13. Your content
If you submit content such as notes, reviews, or messages, you grant AFC a non-exclusive, royalty-free license to use it to operate and improve the Services. You are responsible for the content you submit and confirm that you have the right to submit it.
14. Acceptable use
You agree not to break the law, infringe the rights of others, upload malware, attempt to gain unauthorized access, disrupt or overload the Site, scrape or harvest data, or use the Services to harass others or misrepresent your identity.
15. Third-party services
The Services rely on third parties, including Stripe (payments), Resend (email), Supabase (database), Netlify (hosting), and CoachIQ (member portal). Your use of those features may also be subject to the third party’s terms. We are not responsible for third-party services that we do not control.
16. Disclaimers
- The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
- Training builds skills over time. We do not guarantee any specific athletic, competitive, recruiting, or scholarship outcome.
17. Limitation of liability
- To the fullest extent permitted by law, AFC and its owners, coaches, and staff will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to the Services.
- To the fullest extent permitted by law, AFC’s total liability for any claim relating to the Services is limited to the amount you paid AFC for the specific session or package that gave rise to the claim in the 12 months before the claim.
- Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence or willful misconduct, or any rights of a minor that cannot be waived. The Waiver governs participation-related risks.
18. Indemnification
You agree to indemnify and hold harmless AFC and its owners, coaches, and staff from claims, losses, and expenses, including reasonable legal fees, arising out of your or your athlete’s use of the Services, your content, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
19. Dispute resolution and governing law
- Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
- Informal resolution first. Most concerns can be resolved quickly. Before starting a formal proceeding, please contact us at dre@afctraining.com so we can try to resolve it. Give us 30 days to respond.
- Binding individual arbitration. If we cannot resolve a dispute informally, you and AFC agree to resolve it by binding arbitration on an individual basis, administered by a recognized arbitration provider under its consumer rules, seated in Orange County, California, or conducted by phone or video.
- Class-action waiver. Disputes will be resolved individually. You and AFC waive any right to bring or participate in a class, collective, or representative action.
- Carve-outs. Either party may bring an eligible claim in small-claims court. This section does not apply to claims of physical injury to an athlete, which are governed by the Waiver and applicable law, or to any rights that cannot be waived by law.
- 30-day opt-out. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms; if you do, the courts below will apply.
- Courts. For any matter not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California.
20. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for material changes we will provide notice. Continued use of the Services after a change takes effect means you accept the updated Terms.
21. Termination
You may stop using the Services and ask us to close your account at any time. We may suspend or terminate access for breach of these Terms or to protect the Services or others. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.
22. General
- Entire agreement. These Terms, together with the Privacy Policy and the Waiver, are the entire agreement between you and AFC about the Services.
- Severability. If a provision is found unenforceable, the rest of the Terms remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, such as severe weather, emergencies, or utility and network failures.
