This Participation Agreement, Waiver, Release of Liability, Assumption of Risk, and Indemnity Agreement ("Agreement") is entered into by the undersigned adult ("I" or "you"), individually and on behalf of each participating athlete named on the account or booking ("Athlete"), for the benefit of AFC (Ambition. Foundation. Creation.) of Lake Forest, Orange County, California, together with its owners, members, managers, officers, directors, employees, coaches, trainers, independent contractors, volunteers, agents, insurers, successors, and assigns (collectively, the "Released Parties"). This is a legally binding document — read it in full before signing. If the Athlete is under 18, this Agreement must be accepted by the Athlete's parent or legal guardian; if the participant is 18 or older, "Athlete" also refers to the signer. You accept this Agreement when you sign it during booking, and it applies to the session booked and to all future AFC sessions, programs, camps, and related activities unless a superseding version is accepted. No athlete may participate without this Agreement on file.
I understand that soccer and athletic training are vigorous physical activities involving contact and a genuine risk of injury. The risks include, without limitation: collisions with other athletes, coaches, equipment, goals, or fixed objects; falls; sprains, strains, fractures, and torn ligaments; concussion and other head, neck, and spinal injuries; heat illness and dehydration; cardiac events; permanent disability, paralysis, and death; risks arising from field and surface conditions, weather, and public facilities that AFC does not own or control; risks created by the actions, inactions, or negligence of other participants and third parties; and travel to, from, and between training locations. I acknowledge these risks cannot be eliminated even with careful coaching and supervision, and I knowingly and voluntarily accept and assume all of them — known and unknown, foreseeable and unforeseeable — on my own behalf and on behalf of the Athlete.
To the fullest extent permitted by California law, I — for myself, the Athlete, and our respective heirs, executors, administrators, personal representatives, successors, and assigns — release, waive, forever discharge, and covenant not to sue the Released Parties from and for any and all claims, demands, damages, losses, costs, and causes of action of every kind arising out of or related to the Athlete's participation in AFC sessions, programs, camps, or events, or presence at any training location, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE, WHETHER ACTIVE OR PASSIVE, OF ANY RELEASED PARTY. This release does not extend to gross negligence, willful or wanton misconduct, fraud, or any other liability that cannot lawfully be waived, and it is intended to be as broad and inclusive as California law permits.
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, costs, and expenses (including reasonable attorneys' fees) brought by me, by the Athlete, or by anyone on the Athlete's behalf, arising out of or related to the Athlete's participation or presence at a training location, except to the extent caused by a Released Party's gross negligence or willful misconduct. This obligation survives the end of the Athlete's participation with AFC.
I certify that the Athlete is in good health and proper physical condition to participate and has no illness, injury, or medical condition that would be aggravated by participation or that has not been disclosed to AFC. I agree to notify the coaching staff immediately if the Athlete's health status changes, and I understand AFC may decline or pause participation for safety reasons.
If the Athlete is injured or experiences a medical emergency and I cannot be reached, I authorize AFC staff to secure emergency medical care for the Athlete — including first aid, treatment by emergency medical personnel, and transport to a medical facility — and I consent to that treatment on the Athlete's behalf.
I acknowledge that AFC does not carry medical, health, accident, or disability insurance covering participants. I am solely responsible for maintaining current health insurance covering the Athlete and for all medical, ambulance, and related expenses arising from the Athlete's participation, regardless of cause.
I understand that an athlete suspected of sustaining a concussion or other head injury will be removed from the session immediately and may not return to training until AFC receives written clearance from a licensed health care provider. I acknowledge the seriousness of concussion, head and neck injuries, and sudden cardiac arrest; information on recognizing and responding to them is available from AFC on request. I agree to keep the Athlete out of training while injured or symptomatic and to tell the coaching staff about any recent head injury.
I understand that participation in group training carries a risk of exposure to communicable disease. I assume that risk on behalf of the Athlete, agree the Athlete will not attend while sick or symptomatic, and, to the fullest extent permitted by law, release the Released Parties from any claim arising from exposure to or transmission of any illness in connection with participation.
Athletes are expected to compete hard and to treat coaches, staff, and other athletes with respect; violent, abusive, or unsportsmanlike conduct may result in removal from a session or the program. Parents and guardians agree to watch from designated areas, stay off the field unless invited by a coach, refrain from sideline coaching, and raise concerns directly and respectfully with the coach outside of session time. These standards protect the training environment for every athlete; repeated violations may result in removal from the program, with any refund governed by the posted cancellation and refund policies.
The Athlete will wear appropriate athletic footwear and any protective gear directed by the coaching staff, and will bring water to every session. AFC may decline participation, for safety, when an athlete arrives without proper equipment.
Session scheduling, cancellations, rescheduling, refunds, and no-shows are governed by the cancellation policy shown at booking and by our Terms of Service. As a standard, we ask for at least 24 hours' notice; a late cancellation or no-show may forfeit the session or its fee under that policy. Nothing in this Agreement limits any right you may have under applicable law that cannot be waived.
I grant AFC permission to photograph and record the Athlete during sessions and to use the Athlete's image, likeness, and voice in coaching materials and in AFC's marketing — including social media, the AFC website, and promotional video — without compensation. You may opt out at any time by emailing us; opting out never affects the Athlete's participation or standing.
I agree that checking the waiver box or clicking "I agree" during booking constitutes my electronic signature under the California Uniform Electronic Transactions Act and the federal E-SIGN Act, that it binds me to this Agreement the same as a handwritten signature, and that AFC's record of my acceptance is valid evidence of this Agreement.
This Agreement is governed by California law, and any dispute not resolved informally will be brought in the state or federal courts located in Orange County, California. If any provision is held invalid or unenforceable, the remainder continues in full force, and the invalid provision is deemed modified to the minimum extent needed to make it enforceable. This Agreement supplements our Terms of Service and posted policies, supersedes prior versions of this waiver, and states the complete agreement between us regarding assumption of risk, release, and indemnity.
I certify that I am the Athlete's parent or legal guardian (or the participant, if 18 or older), that I have full authority to enter this Agreement on the Athlete's behalf, and that the information I provide is accurate. I have read this entire Agreement and understand that by signing I am giving up substantial legal rights, including rights the Athlete may otherwise have. I sign freely and voluntarily, intending this Agreement to bind me, the Athlete, and our heirs, personal representatives, and assigns.
